1. Acceptance of Terms

By accessing or using TintFam.com ("the Site", "the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Platform. We reserve the right to update or modify these Terms at any time without prior notice. Your continued use of the Platform following any changes constitutes acceptance of the revised Terms.

2. About the Platform

TintFam.com is a multi-seller marketplace that connects buyers with independent sellers offering tools, apparel, gear, and other products related to the window tinting industry. Tint Fam operates the Platform but is not the seller of the products listed. Each seller is an independent party responsible for the products they list, including their accuracy, quality, and fulfillment. Tint Fam facilitates transactions between buyers and sellers and collects a commission on each sale.

3. Account Registration

To make purchases or sell on the Platform, you must create an account. You agree to:

• Provide accurate, current, and complete information during registration.
• Maintain and promptly update your account information.
• Keep your password secure and confidential.
• Accept responsibility for all activity that occurs under your account.
• Notify us immediately of any unauthorized use of your account.

You must be at least 18 years of age to create an account and use the Platform.

4. Seller Terms

Sellers on TintFam.com operate as independent parties. By listing products on the Platform, sellers agree to the following:

• All product listings must be accurate, truthful, and not misleading.
• Sellers are solely responsible for the quality, safety, and legality of their products.
• Sellers must fulfill orders promptly and in accordance with the details provided in the listing.
• Tint Fam collects a 10% commission on each completed sale.
• Payment processing is handled through Stripe. Sellers must maintain a valid Stripe account.
• Tint Fam may remove listings, suspend, or terminate seller accounts at any time and for any reason, with or without notice.

5. Purchases and Payments

All prices on the Platform are listed in United States Dollars (USD). Applicable taxes are calculated at checkout via our tax calculation provider. By placing an order, you agree to pay the full amount including product price, shipping, and applicable taxes.

Payment is processed securely through Stripe. Tint Fam does not store your full credit card information on our servers. All transactions are subject to Stripe's terms and conditions.

6. Shipping

Shipping is facilitated through Shippo and fulfilled by the individual seller. Shipping rates and estimated delivery times are provided at checkout and may vary depending on the seller, product, and destination. Tint Fam is not responsible for delays, losses, or damages that occur during shipping. Any shipping disputes should be directed to the seller or shipping carrier.

7. Refunds and Returns

Refund requests are handled on a case-by-case basis. No refund is guaranteed. Please refer to our Refund Policy for full details on the refund process, eligibility, and timeframes.

8. User Conduct

You agree not to use the Platform to:

• Engage in any fraudulent, deceptive, or misleading activity.
• List, sell, or purchase counterfeit, stolen, or illegal products.
• Harass, threaten, or abuse other users, sellers, or Tint Fam staff.
• Interfere with or disrupt the operation of the Platform.
• Attempt to gain unauthorized access to any part of the Platform or its systems.
• Use automated tools, bots, or scripts to access or scrape the Platform without prior written consent.
• Violate any applicable local, state, national, or international law.

Tint Fam reserves the right to investigate and take appropriate action against anyone who, in our sole discretion, violates these rules, including removing content, suspending or terminating accounts, and reporting violations to law enforcement.

9. Account Suspension and Termination

Tint Fam reserves the right to suspend, restrict, or terminate your account and access to the Platform at any time, for any reason, with or without notice. This includes, but is not limited to, violations of these Terms, suspected fraud, or any activity that we determine to be harmful to the Platform, its users, or third parties. Tint Fam may also cancel any pending or confirmed orders at its sole discretion.

10. Intellectual Property

All content on the Platform, including but not limited to text, graphics, logos, images, and software, is the property of Tint Fam or its content suppliers and is protected by United States and international intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any content on the Platform without prior written consent from Tint Fam.

11. Dispute Resolution

If a dispute arises between you and Tint Fam, we encourage you to contact us at support@tintfam.com to attempt to resolve the matter informally.

If a dispute cannot be resolved informally, you agree that any claim or controversy arising out of or relating to these Terms or the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. Arbitration shall take place in the United States. You agree to waive your right to a jury trial and to participate in any class action lawsuit against Tint Fam.

12. Limitation of Liability

To the fullest extent permitted by applicable law, Tint Fam, its officers, directors, employees, agents, and affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, goodwill, or other intangible losses, resulting from:

• Your access to or use of (or inability to access or use) the Platform.
• Any conduct or content of any third party on the Platform, including sellers.
• Any products purchased through the Platform.
• Unauthorized access, use, or alteration of your transmissions or content.

In no event shall Tint Fam's total liability to you for all claims exceed the amount you paid to Tint Fam in the twelve (12) months preceding the event giving rise to the claim.

13. Disclaimer of Warranties

The Platform is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Tint Fam does not warrant that the Platform will be uninterrupted, error-free, or secure, or that any defects will be corrected. Tint Fam makes no representations or warranties regarding the accuracy or completeness of any content on the Platform, including product listings provided by sellers.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
